2012 Renewal Analysis

The 2012 P&I renewal has now been completed and we trust that our Clients feel that a successful conclusion has been the result.

We have since then conducted an audit of the renewal, paying particular attention to any specific terms included in the certificate of entry for each ship.

Specific terms are generally crew cover clauses, trading limits, warranties pertaining to cargoes carried and the like. Some of these specific terms date back several years to when a ship was first entered with the Club.

With the changing shipping market situation and re-deployment of ships or changes in crew, some of the original specific terms may no longer be appropriate.

While in many cases specific terms have been updated, there is always a possibility that a new trading pattern or crew contract is yet to be advised and agreed with the P&I Club.

We therefore recommend that Clients review their terms of entry of each ship to ensure that any specific terms are appropriate for the current operation and crewing of the ship.

In respect of crew cover, even if there are no specific terms of entry in the Certificate of Entry, there is an obligation on the member to advise the Club of any changes in the crew contract.

A typical Rule on crew cover will read:

…including costs and expenses arising under any contract including collective agreement APPROVED IN WRITING BY THE MANAGERS PRIOR TO THE EVENT GIVING RISE TO A CLAIM

It is therefore essential that Members ensure that their current crew contracts/collective agreements have been or are advised and approved by their Club to ensure that crew cover is not prejudiced in any way.

Obviously with other specific terms such as trading warranties, it is essential to check that these match the current operation of the ship and if not, to obtain the Club's agreement to any changes necessary.

We would therefore prevail upon our Clients to advise us of any changes required to any specific terms of entry, or confirm that the current terms are appropriate to the present operation of their ship[s].
